NYCTRR § 4-08(e)(5), “Stop in Crosswalk – NYC”

New York City Traffic Rules & Regulations § 4-08(e)(5) prohibits motorists from stopping, standing, or parking in a crosswalk. The fine is $138. Being found guilty or pleading guilty to this violation will put two points on your driver’s license. Most importantly, such violations on your driving record typically cause increased insurance rates.

Text of NYCTRR

The wording of the relevant regulation is as follows:

(e) General no stopping zones (stopping, standing and parking prohibited in specified places). No person shall stop, stand, or park a vehicle in any of the following places, unless otherwise indicated by posted signs, markings or other traffic control devices, or at the direction of a law enforcement officer, or as otherwise provided in this subdivision:

……………….

(5) Crosswalks. In a crosswalk.

Fighting a 4-08(e)(5) Traffic Ticket

Traffic tickets in the five boros of New York City are handled differently than tickets in the rest of New York State. Plea bargaining is not permitted. If you plead not guilty to a traffic ticket, your case will be scheduled for an administrative hearing at one of the offices of the New York City Traffic Violations Bureau (TVB).

At the hearing, testifying that what the officer is saying is inaccurate rarely helps to win the case. The best way to beat a traffic ticket is by finding something wrong, whether a contradiction or omission, whether factual or legal, with the ticket, the officer’s testimony, or the officer’s notes. There are several possible defenses to the charge of stopping in a crosswalk and an attorney that has experience with the TVB is in the best position to beat the case.
