Vehicle & Traffic Law 1111(d)2b, “Failed to Yield Left on Red”
Not to be confused with VTL 1111(d) 2a, “Failed to Yield Right on Red”
A ticket for VTL 1111(d)2b is rarely issued. This is because the circumstances that would allow for such a violation do not really exist in New York State. VTL 1111(d)2b firstly is only for cities that have a population of less than one million. It allows a motorist to make a left turn at a redlight only from one-way street to another one-way street. But the failure to yield to another car or pedestrian will result in a violation of VTL 1111(d)2b. However, since such intersections with redlights do not really exist, it is almost impossible to get charged with this violation. If you manage to get this ticket you will get three points on your New York State driving record. The fine is up to the judge, with the maximum being $150 + $93 mandatory state surcharge for a first-time offense. You can expect to see increased insurance premiums if this appears on your driving record.
Text of Statute
Traffic, while on a one-way roadway, facing a steady red signal may cautiously enter the intersection to make a left turn onto a one-way roadway after stopping as required by paragraph one of this subdivision. Such traffic shall yield the right-of-way to pedestrians within a marked or unmarked crosswalk at the Intersection and to other traffic lawfully using the intersection.
Fighting a VTL 1111(d)2b Traffic Ticket
Whether the charges are true or not true, you can still dispute the ticket. There is nothing illegal or unethical about submitting a Not Guilty to a traffic ticket even if the charges are true. Pleading Not Guilty means you are utilizing your Constitutional right to require the “People” to prove their case. It does not mean you are denying what occurred. Instead of going through the hassle of proving their case, the prosecutor will give you a plea offer that would allow you to get the fine and points reduced. If handled well, you may even be able to get the charges dismissed entirely.
A traffic ticket lawyer can help in two ways. One, a seasoned traffic lawyer in the best position to obtain the most optimal disposition. Two, they can file the Not Guilty plea for you in court and make any court appearances in your place.
